Protective seizure in divorce cases and welcome news of a review of civil justice

Yesterday the Supreme Court allowed two women to have their divorce settlements reanalysed after their ex-husbands were found to have hidden assets, and last month a judge awarded significant costs to the wife after her ex-husband’s “blatant dishonesty” in hiding his assets. We look at how a High Court writ of control can be used as a form of protective seizure to prevent assets “disappearing” once an award is made.
We also welcome the review of civil justice by Lord Justice Briggs and look at the areas he will be investigating prior to his interim report at the end of this year. Finally we cover the different types of residences and properties where enforcement is not permitted.
